1. Overview

This Terms & Conditions Agreement (“Agreement”) is entered into between you (“User”) and Ubon Patrusm, an individual, who is the creator and publisher of the ServerPulse AI product (“we” or “us”).

These Terms & Conditions define the scope, structure, and principles for using Server Pulse AI. The Terms are not just a legal artifact — they are a trust contract between Server Pulse AI and its users. We believe in readable, fair terms that align with how the product actually works.

Our core principles are:

• Clarity over complexity – No legal traps
• Reality-based terms – Matches actual product behavior
• User-first fairness – No surprise restrictions
• Explicit AI boundaries – Clear limits on responsibility

2. Account & Access

Requirements

• Users must be 18 years of age or legally permitted to enter into contracts
• Users must provide accurate account information
• One account per individual unless on a team plan

Responsibilities

• Users are responsible for safeguarding their account credentials
• Server Pulse AI is not liable for compromised accounts due to user negligence
• Users must notify Server Pulse AI immediately of any unauthorized access

3. Acceptable Use Policy

Allowed Use

You may use Server Pulse AI for:

• Monitoring local development services
• Analyzing errors and failures in your development environment
• Educational and commercial development work

Prohibited Use

You may not use Server Pulse AI to:

• Monitor production systems without explicit permission
• Upload illegal, malicious, or abusive content
• Reverse engineer or scrape Server Pulse AI services
• Violate privacy or data protection laws
• Interfere with or disrupt Server Pulse AI services or infrastructure

4. AI Analysis Disclaimer

Server Pulse AI uses artificial intelligence to analyze errors and suggest fixes. It is important to understand the following:

• AI analysis is assistive, not authoritative – The AI provides suggestions based on patterns it has learned, not definitive answers
• Outputs are best-effort suggestions, not guarantees – AI-generated analysis may be incomplete or incorrect
• You remain responsible – Users are responsible for final decisions and fixes applied to their systems

Explicit Limitations

• No guarantee of correctness – AI analysis may produce incorrect results
• No warranty of fitness for a particular purpose
• AI may produce incomplete analysis or miss relevant context
• Server Pulse AI is not liable for decisions made based on AI suggestions

Always review and test AI suggestions before applying them to your systems.

5. Data & Privacy Alignment

Server Pulse AI is built for engineers who care about data ownership and privacy. Our data handling practices are designed to be transparent, minimal, and trust-building.

• No ownership claim over user logs – Your logs remain yours
• Limited, opt-in data processing – We process only what is necessary for the service
• No resale or sharing of user data – We do not sell or share your data

By default, Server Pulse AI analyzes locally. Cloud analysis is opt-in and limited to what's necessary for AI reasoning.

6. Subscription & Billing Terms

Billing

• Server Pulse AI operates on a subscription-based access model
• Charges recur automatically unless canceled
• Proration rules apply when upgrading or downgrading plans
• Refunds are handled on a case-by-case basis

Changes

• Pricing or usage limits may change with reasonable notice
• Existing subscriptions are honored until the next renewal period
• Material changes will be communicated via email

Non-Payment

• A grace period is provided before downgrade or suspension
• No data loss occurs on downgrade
• Service access is restored upon payment

7. Usage Limits & Fair Use

Server Pulse AI operates on a tiered subscription model with defined analysis limits for each tier.

• Each tier has clearly defined analysis limits
• Abuse prevention mechanisms are in place
• Excessive or automated abuse may result in throttling or suspension

No silent throttling – Users will be notified before any throttling is applied.

Fair use means using Server Pulse AI in a manner consistent with normal development workflows. Attempting to exceed limits through automation, abuse, or circumvention of system limits is prohibited.

8. Availability & Reliability

• Service is provided on an "as-is" basis
• No guaranteed uptime unless contractually agreed (e.g., enterprise plans)
• Planned maintenance may occur with reasonable notice
• Server Pulse AI is not liable for service interruptions or downtime

While we strive for high availability, Server Pulse AI does not guarantee uninterrupted access. Maintenance windows and system updates may temporarily affect service availability.

9. Intellectual Property

• Server Pulse AI retains ownership of the Server Pulse AI product, branding, and all related intellectual property
• Users retain ownership of their code, logs, and user-generated content
• Limited license – No license is granted to user content beyond what is necessary for service operation

By using Server Pulse AI, you grant Server Pulse AI a limited license to process your data solely for the purpose of providing the service. This license terminates when you stop using the service.

10. Termination

By User

• Users may cancel their subscription at any time
• No penalties or fees for cancellation
• Access continues until the end of the current billing period
• Data export may be available upon request

By Server Pulse AI

Server Pulse AI may suspend or terminate accounts for:

• Abuse of the service or violation of acceptable use policy
• Illegal activity
• Severe Terms of Service violations

Clear notice required – Server Pulse AI will provide reasonable notice before suspension or termination, except in extreme cases involving illegal activity or immediate threats to service integrity.

11. Liability Limitations

To the maximum extent permitted by law:

• Server Pulse AI is not liable for indirect or consequential damages
• Total liability is capped at the amount paid in the last billing period
• Server Pulse AI is not liable for decisions made based on AI analysis
• Server Pulse AI is not liable for data loss, except as required by law

12. Changes to Terms

• Users will be notified of material changes to these Terms
• Notification will be provided via email and/or in-service notification
• Continued use of the service after changes constitutes acceptance

If you do not agree to the modified Terms, you may cancel your subscription before the changes take effect.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
